Town of Clinton Zoning Board of Appeals

A conditional side yard setback variance was granted to Joseph and Shari Jordan of 84 Sunset Trail at the Clinton ZBA meeting Dec. 5. The Jordans had requested permission for a setback of 20 feet, instead of the required 50, in order to build a new storage barn at the rear of their property. Due to the proximity to the property line, no outdoor storage will be permitted next to the barn. The ZBA requested that the Jordans resolve any existing compliance issues involving driveway access to the site, which is required to be at least 10 feet from the property line.

Phillips Drive public hearing continued
A public hearing on the application to change lot lines and transfer acreage between properties at 5, 7 and 9 Phillips Drive and another adjacent parcel was held at the Dec. 4 planners’ meeting. The goal of the change is to transfer enough land to a 2.2 acre landlocked parcel to provide room for a driveway and road frontage. Andrew and Krista Dahowski own the property at 9 Phillips Drive; Joan and Lloyd Quick own the three other properties involved in the application.

The board said that it had heard back from the DEC, DOH and other agencies and that the only comment came from the DEC stating that if a future property owner were to build on the lot, that a permit would be needed if the construction was within 50 ft. of the pond on the property. The board agreed that a notation on the map to that effect would need to be filed for the pond. The public hearing was adjourned and will be continued on Dec. 18.

Creek Road setback changes approved
The Rugars, of 516 Creek Road, received an approval from the ZBA on Dec. 11 for their request to change the front yard setback to 27 feet and the side yard setback to 18 feet to accommodate the construction of a deck on the front of their home in the Greenbelt District.

Matuk Drive setback change approved
Roy Hall, of 9 Matuk Drive, received an approval from the ZBA on Dec. 11 for a new front yard setback of 42 feet (rather than 50) to accommodate the construction of a new addition to the single-family home in the Greenbelt District.

Larger letters OK’d for Rockledge Plaza
Following a public hearing on Dec. 11, the ZBA approved a request to change the wall lettering from 10 inches to 12 inches tall for signs at Rockledge Plaza, located at 1164 Route 9G. The signs are for Best Pals Pet Grooming, Dutchess Scuba Diving and Elite Martial Arts.

Farm Lane setback approved for 17 feet
Robert Morrison’s request to change the front yard setback for his property at 8 Farm Lane was approved on Dec. 11 after a public hearing. The change was requested to allow for the addition of an unenclosed front porch and stairs in the Neighborhood District.

Vanderbilt Lane setback approved for sunroom
Steven and Angela Barreca’s application was approved on Dec. 11 to change the side yard setback from 50 feet to 22 feet to allow for a second-floor deck that has already been converted into a 12×14 sunroom/enclosed porch. The porch at 18 Vanderbilt Lane never got a final inspection due to an address change from Carriage House Court in 2005.

Cedar Lane hearing continued to Jan. 22
A public hearing was opened but nobody was present to speak regarding a request to allow construction within the 100-foot stream corridor at 502 Cedar Lane. The change would allow the reconstruction and extension of a deck at the Staatsburg address. The hearing was adjourned and will be continued at the meeting on Jan. 22.

Richard Road hearing to allow animal husbandry set for Jan. 22
Brian and Karen Moon, of 26 Richard Rd., are asking for approval to allow animal husbandry — the raising and care of farm animals — at their property. Current zoning law in the Neighborhood District requires at least 350 feet of buffer between the property and the nearest neighbors. The ZBA plans to schedule the public hearing on this issue for Jan. 22.

White Oaks Road application to allow two-family home
Linda Haenichen, of 33 White Oaks Road, presented an application to change her single-family home to a two-family home to allow for rentals. A public hearing may be scheduled for Jan. 22.
